The Botpress Hub is a community platform where Authorized Users may publish certain bot components (“Hub Component”) for other members to use and use Hub Components made available on the Botpress Hub in their own Customer Bot.
These terms apply to any Customer or Authorized User accessing or using the Botpress Hub. These terms supplement the Botpress Terms of Services and must be interpreted in accordance with the Botpress Terms of Service and all attached documents. Capitalized terms not defined herein shall have the meaning ascribed to such terms in the Botpress Terms of Service.
In these Botpress Hub Terms:
“Contributor” means an Authorized User who publishes a Hub Component on the Botpress Hub;
“User” means an Authorized User who uses a Hub Component published on the Botpress Hub to build a Customer Bot;
“Hub Component” means a program, application, routine meant to be used to build Customer Bots in the Botpress Studio.
“Botpress Hub” means the community platform permitting Contributors to publish content and Users to use community sourced content in connection with Customer Bots;
Botpress does not claim to acquire ownership rights in or to the Hub Components. As between Botpress and the Contributor, the Contributor shall retain ownership of all rights in and to the Hub Components.
The Contributor hereby grants Botpress, a perpetual, nonexclusive, royalty-free, worldwide right and license:
(a) to distribute or make available (including via download), as applicable, the Hub Components through the Botpress Hub to Users by all means of electronic distribution available now or in the future;
(b) to use, reproduce, distribute, reformat, modify, adapt, create excerpts from, promote, advertise, transmit, and publicly display any portion of the Hub Components;
(c) otherwise use, store, copy and distribute Hub Components, including (i) for testing and evaluation conducted by Botpress and its third-party service providers; (ii) for the purpose of exercising Botpress’ rights and fulfilling Botpress’ obligations hereunder;
(d) to use the Hub Components for Botpress’ own internal business purposes. Botpress will not sell paid licenses to Hub Components without the Contributors consent.
By posting a Hub Component to the Botpress Hub, a Contributor grants all Users a license to use such Hub Component for the sole purpose of including the Hub Component in a Customer Bot through the Botpress Studio. Users are permitted to use Hub Components from the Botpress Hub to the same extent they are permitted to use the Customer Bot in which the Hub Component is included.
Users may not sell, distribute or otherwise commercially exploit Hub Components except as part of a Customer Bot in accordance with the Botpress Terms of Service.
Contributors and Users are free to enter into different contractual arrangements between themselves with respect to Hub Components to the extent such arrangements do not conflict with these terms or the Botpress Terms of Service and do not impose any obligation on Botpress.
User and Contributors are third-party beneficiaries of the obligations set forth in this Section 2 and may invoke the provisions contained therein against a Contributor or User as the case may be.
Botpress may, in its absolute discretion, remove any Hub Component from the Botpress Hub for any reason or for no reason.
Contributors may not:
(a) Upload content containing Malicious Code or Objectionable Content to the Botpress Hub;
(b) Upload content infringing on intellectual property rights of any person to the Botpress Hub;
(c) Upload content violating applicable law to the Botpress Hub;
(d) Knowingly upload a dysfunctional Hub Component to the Botpress Hub;
(e) Knowingly upload a Hub Component containing security vulnerabilities to the Botpress Hub;
Users may not :
(f) Copy all or part of a Hub Component or the related Documentation (except for reasonable use hereunder);
(g) Create any derivative work from Hub Components;
(h) Distribute or disseminate Hub Components outside of the Botpress Hub;
(i) Commercialize access to content provided on the Botpress Hub;
(j) Seek to disable or circumvent any protection mechanism related to the Botpress Hub or Hub Components;
A violation of this Section 3 constitutes a material breach under the Botpress Terms of Service and may result in the immediate suspension of the Customer’s or an Authorized User’s access to the Software Services.
The Hub Components are provided by third-party Contributors. Botpress does not endorse Hub Component nor provide any warranty or representation about Hub Components. Users use Hub Components entirely at their own risk.
Botpress does not have the duty to (a) inspect the Hub Components, (b) make any determination about the performance, compatibility or safety of Hub Components or (c) remove Hub Components that are in violation of these terms from the Botpress Hub. Users are solely responsible for reviewing Hub Components before including such Hub Components into Customer Bots or making any other use thereof.
Contributors and Users’ use of the Botpress Hub is entirely at their own risk. The Botpress Hub is provided "as is" and, to the extent permitted by law, without warranty of any kind, whether express or implied.
Unless otherwise stated by a Contributor, Hub Components are provided by Contributors without any warranty of any kind, whether express or implied.
Except for damages resulting directly from Botpress’ own intentional misconduct or gross negligence, Botpress shall not be liable for any damage that may be suffered by a Contributor or a User in connection with the Botpress Hub, including damages resulting from malicious actions by a Contributor or User.
Users agree that except for liability arising from a Contributor’s gross negligence or intentional misconduct, that Contributor shall not incur any liability for damages suffered by Users in connection with their use of Hub Components published by that Contributor in good faith.
The Contributor agrees to indemnify, defend and hold harmless Botpress and its directors, officers, employees, shareholders, consultants and affiliates (collectively the "Botpress Indemnitees") from and against any and all third party claims brought against any of the Botpress Indemnitees (including, without limitation, any direct or indirect costs, losses, liabilities, fines, judgments, costs, interest, penalties or expenses, including reasonable disbursements and fees of their legal counsel, which they may incur as a result of any such claims) arising from:
(a) the use of a Hub Component published by such Contributor;
(b) the alleged or actual infringement of the Intellectual Property Rights of a third- party by a Hub Component or any use thereof by a User;
(c) any malfunction or damage caused by a Hub Component published by such Contributor;
The User agrees to indemnify, defend and hold harmless Botpress and its directors, officers, employees, shareholders, consultants and affiliates (collectively the "Botpress Indemnitees") from and against any and all third party claims brought against any of the Botpress Indemnitees (including, without limitation, any direct or indirect costs, losses, liabilities, fines, judgments, costs, interest, penalties or expenses, including reasonable disbursements and fees of their legal counsel, which they may incur as a result of any such claims) arising from:
(a) any use of Hub Components by such User;
(b) any damage caused by a Hub Component;
(c) any unauthorized use of content published on the Botpress Hub;
The Contributor’s or User’s obligation to indemnify Botpress shall not apply to the extent the damage subject to indemnification is caused entirely by Botpress’ own negligence or intentional misconduct.
Botpress may update Botpress Hub Terms at any time by posting modified terms. Contributors and Users will need to accept the modified terms before accessing the Botpress Hub once the modified terms are in force.
